The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.<\/p>\n\n<p><b>1.2<\/b>&nbsp;For the purposes of these General Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that can be attributed neither to their commercial nor to their independent professional activity.<\/p>\n\n<p><b>1.3<\/b>&nbsp;For the purposes of these General Terms and Conditions, an entrepreneur is a natural or legal person or a partnership with legal capacity that, upon concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.<\/p>\n\n<h2>2) Conclusion of Contract<\/h2>\n\n<p><b>2.1<\/b>&nbsp;The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but rather serve as a basis for the customer to submit a binding offer.<\/p>\n\n<p><b>2.2<\/b>&nbsp;The customer may submit an offer via the online order form integrated into the seller's online shop. By placing selected goods into the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding offer to purchase the goods contained in the shopping cart upon clicking the button that concludes the ordering process.<\/p>\n\n<p><b>2.3<\/b>&nbsp;The seller can accept the customer's offer within five days.<\/p>\n\n<ul>\n<li>by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the customer is decisive, or<\/li>\n<li>by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive in this respect, or<\/li>\n<li>by requesting payment from the customer after the customer has placed their order.<\/li>\n<\/ul>\n\n<p>If several of the aforementioned alternatives apply, the contract is concluded at the moment one of those alternatives occurs first. The period for accepting the offer begins on the day following the dispatch of the offer by the customer and ends at the close of the fifth day following such dispatch. If the seller does not accept the customer's offer within the aforementioned period, this is deemed a rejection of the offer, with the result that the customer is no longer bound by their declaration of intent.<\/p>\n\n<p><b>2.4<\/b>&nbsp;When selecting a payment method offered by PayPal, payment processing is handled by the payment service provider PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: \"PayPal\"), subject to the PayPal Terms of Use, which can be viewed at <a href=\"https:\/\/www.paypal.com\/de\/legalhub\/paypal\/useragreement-full\" target=\"_blank\">https:\/\/www.paypal.com<wbr>\/de<wbr>\/legalhub<wbr>\/paypal<wbr>\/useragreement-full<\/a> or \u2013 if the customer does not have a PayPal account \u2013 subject to the terms and conditions for payments without a PayPal account, available for viewing at <a href=\"https:\/\/www.paypal.com\/de\/legalhub\/paypal\/privacywax-full\" target=\"_blank\">https:\/\/www.paypal.com<wbr>\/de<wbr>\/legalhub<wbr>\/paypal<wbr>\/privacywax-full<\/a>. If the customer pays using a payment method offered by PayPal that can be selected during the online ordering process, the seller hereby declares acceptance of the customer's offer at the moment the customer clicks the button that completes the ordering process.<\/p>\n\n<p><b>2.5<\/b>&nbsp;When ordering via the seller's online order form, the text of the contract is stored by the seller after the contract is concluded and transmitted to the customer in text form (e.g., e-mail, fax, or letter) after the order has been submitted. The seller does not make the contract text available beyond this. If the customer has created a user account in the seller's online shop prior to submitting the order, the order data is archived on the seller's website and can be accessed by the customer free of charge via their password-protected user account using the corresponding login details.<\/p>\n\n<p><b>2.6<\/b>&nbsp;Before submitting a binding order via the seller\u2019s online order form, the customer can identify potential input errors by carefully reading the information displayed on the screen. The browser\u2019s zoom function, which enlarges the on-screen display, can serve as an effective technical aid for better detecting such errors. During the electronic ordering process, the customer can correct their entries using standard keyboard and mouse functions until they click the button that completes the order process.<\/p>\n\n<p><b>2.7<\/b>&nbsp;Various languages \u200b\u200bare available for concluding the contract. The specific language options are displayed in the online shop.<\/p>\n\n<p><b>2.8<\/b>&nbsp;Order processing and communication generally take place via email and automated order processing systems. The customer must ensure that the email address provided for order processing is correct so that emails sent by the seller can be received at that address. In particular, if spam filters are used, the customer must ensure that all emails sent by the seller\u2014or by third parties commissioned by the seller to handle order processing\u2014can be delivered.<\/p>\n\n<h2>3) Right of Withdrawal<\/h2>\n\n<p><b>3.1<\/b>&nbsp;Consumers generally have a right of withdrawal.<\/p>\n\n<p><b>3.2<\/b>&nbsp;Further information regarding the right of withdrawal can be found in the seller's instructions on the right of withdrawal.<\/p>\n\n<h2>4) Prices and Terms of Payment<\/h2>\n\n<p><b>4.1<\/b>&nbsp;Unless otherwise stated in the seller's product description, the prices quoted are total prices that include statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description.<\/p>\n\n<p><b>4.2<\/b>&nbsp;For deliveries to countries outside the European Union, additional costs may arise in individual cases that are beyond the seller's control and must be borne by the customer. These include, for example, costs associated with money transfers handled by financial institutions (such as transfer fees or currency exchange fees) or import duties and taxes (such as customs duties). Costs related to money transfers may also be incurred even if the delivery is not made to a country outside the European Union, provided the customer initiates the payment from a country outside the European Union.<\/p>\n\n<p><b>4.3<\/b>&nbsp;The payment method(s) will be communicated to the customer in the seller's online shop.<\/p>\n\n<p><b>4.4<\/b>&nbsp;When a payment method offered via the \"PayPal\" payment service is selected, payment processing is handled by PayPal; PayPal may utilize the services of third-party payment service providers for this purpose. If the seller offers payment methods via PayPal that involve the seller extending credit to the customer (e.g., purchase on invoice or installment payments), the seller assigns the resulting payment claim to PayPal or to a payment service provider commissioned by PayPal and specifically identified to the customer. Before accepting the seller's declaration of assignment, PayPal or the payment service provider commissioned by PayPal conducts a credit check using the transmitted customer data. The seller reserves the right to refuse the selected payment method to the customer in the event of a negative credit check result. If the selected payment method is approved, the customer must pay the invoice amount within the agreed payment period or at the agreed payment intervals. In this case, payment may only be made to PayPal or the payment service provider commissioned by PayPal with discharging effect. However, even in the event of such an assignment of claims, the seller remains responsible for general customer inquiries\u2014for example, regarding goods, delivery times, shipping, returns, complaints, notices of withdrawal, or credit notes.<\/p>\n\n<p><b>4.5<\/b>&nbsp;When selecting the payment method \"Instant Bank Transfer,\" payment processing is handled by Klarna Bank AB (publ), Sveav\u00e4gen 46, 11134 Stockholm, Sweden (hereinafter \"Klarna\"). To pay the invoice amount via \"Instant Bank Transfer,\" the customer must have an online banking account enabled for \"Instant Bank Transfer,\" authenticate themselves accordingly during the payment process, and confirm the payment instruction. The payment transaction is then carried out immediately by Klarna, and the customer's bank account is debited. Further information on the \"Instant Bank Transfer\" payment method can be found online at <a href=\"https:\/\/www.klarna.com\/sofort\/\" target=\"_blank\">https:\/\/www.klarna.com<wbr>\/sofort<wbr>\/<\/a> .<\/p>\n\n<p><b>4.6<\/b>&nbsp;If a payment method offered via the \"Apple Pay\" payment service is selected, payment processing is handled by Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland (\"Apple\"). The specific payment methods offered via Apple Pay are indicated to the customer in the seller's online shop. To process payments, Apple may utilize other payment services; these may be subject to specific payment terms, of which the customer will be notified separately where applicable. Further information on Apple Pay is available online at <a href=\"https:\/\/www.apple.com\/de\/apple-pay\/\" target=\"_blank\">https:\/\/www.apple.com<wbr>\/de<wbr>\/apple-pay<wbr>\/<\/a> .<\/p>\n\n<p><b>4.7<\/b>&nbsp;If a payment method offered via the \"Google Pay\" payment service is selected, payment processing is carried out by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (\"Google\"). The specific payment methods offered via Google Pay are displayed to the customer in the seller's online shop. To process payments, Google may utilize other payment services; these may be subject to specific payment terms, of which the customer will be separately notified where applicable. Further information on Google Pay is available online at <a href=\"https:\/\/pay.google.com\/intl\/de_de\/about\/\" target=\"_blank\">https:\/\/pay.google.com<wbr>\/intl<wbr>\/de_de<wbr>\/about<wbr>\/<\/a> .<\/p>\n\n<p><b>4.8<\/b>&nbsp;If you select a payment method offered via the \u201cKlarna\u201d payment service, payment is processed via Klarna Bank AB (publ), Sveav\u00e4gen 46, 111 34 Stockholm, Sweden (hereinafter \u201cKlarna\u201d). Further information and Klarna\u2019s terms and conditions can be found here:<\/p>\n\n<p><a href=\"https:\/\/sanoia-jewelry.com\/en\/agbs\/\" target=\"_blank\">https:\/\/www.sanoia-jewelry.com<wbr>\/agbs<\/a><\/p>\n\n<p><b>4.9<\/b>&nbsp;If credit card payment is selected, the invoice amount is due immediately upon conclusion of the contract. Credit card payments are processed in cooperation with PAYONE GmbH (Lyoner Str. 9, 60528 Frankfurt\/Main), which the seller has authorized to collect payments on its behalf. PAYONE GmbH collects the invoice amount from the customer's specified credit card account. The credit card is charged immediately after the customer submits their order in the online shop. Even when paying by credit card via PAYONE GmbH, the seller remains responsible for general customer inquiries\u2014such as those regarding the goods, delivery times, shipping, returns, complaints, notices of withdrawal, or credit notes.<\/p>\n\n<p><b>4.10<\/b>&nbsp;If credit card payment is selected, the invoice amount is due immediately upon conclusion of the contract. Credit card payments are processed in cooperation with secupay AG, Goethestr. 6, 01896 Pulsnitz (www.secupay.ag), to whom the provider assigns its payment claim. secupay AG collects the invoice amount from the customer's specified credit card account. In the event of such an assignment, payment may only be made to secupay AG with discharging effect. The credit card is charged immediately after the customer submits their order in the online shop. Even when paying by credit card via secupay AG, the provider remains responsible for general customer inquiries\u2014such as those regarding returns, complaints, notices of withdrawal, or credits.<\/p>\n\n<p><b>4.11<\/b>&nbsp;If the credit card payment method via Stripe is selected, the invoice amount is due immediately upon conclusion of the contract. Payment processing is handled by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter referred to as \"Stripe\"). Stripe reserves the right to conduct a credit check and to refuse this payment method in the event of a negative credit assessment.<\/p>\n\n<h2>5) Delivery and Shipping Terms<\/h2>\n\n<p><b>5.1<\/b>&nbsp;If the seller offers shipping, delivery is made to the delivery address specified by the customer within the delivery area indicated by the seller, unless otherwise agreed. The delivery address specified during the seller's order processing is decisive for the handling of the transaction.<\/p>\n\n<p><b>5.2<\/b>&nbsp;If delivery of the goods fails for reasons attributable to the customer, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the costs of the initial shipment if the customer effectively exercises their right of withdrawal. Regarding return shipping costs, the provisions set out in the seller's instructions on the right of withdrawal shall apply if the customer effectively exercises that right.<\/p>\n\n<p><b>5.3<\/b>&nbsp;If the customer acts as a business, the risk of accidental loss or deterioration of the sold goods passes to the customer as soon as the seller has handed the goods over to the freight forwarder, carrier, or other person or entity designated to carry out the shipment. If the customer acts as a consumer, the risk of accidental loss or deterioration of the sold goods generally passes to the customer only upon delivery of the goods to the customer or to a person authorized to receive them. By way of exception to this, even in the case of consumers, the risk of accidental loss or deterioration of the sold goods passes to the customer as soon as the seller has handed the goods over to the freight forwarder, carrier, or other person or entity designated to carry out the shipment, provided that the customer commissioned said freight forwarder, carrier, or other person or entity to perform the shipment and the seller had not previously named that person or entity to the customer.<\/p>\n\n<p><b>5.4<\/b>&nbsp;If the customer acts as a consumer based in Germany or as a business, the seller reserves the right to withdraw from the contract in the event of incorrect or improper delivery by its own suppliers. However, this applies only if the non-delivery is not attributable to the seller and the seller has concluded a specific covering transaction with the supplier with due care. The seller will make all reasonable efforts to procure the goods. In the event that the goods are unavailable or only partially available, the customer will be informed immediately, and any payment made will be refunded without delay.<\/p>\n\n<p><b>5.5<\/b>&nbsp;Self-pickup is not possible for logistical reasons.<\/p>\n\n<h2>6) Retention of title<\/h2>\n\n<p>If the seller performs in advance, he retains ownership of the delivered goods until the purchase price owed has been paid in full.<\/p>\n\n<h2>7) Liability for defects (statutory warranty)<\/h2>\n\n<p>Unless otherwise provided in the following provisions, the statutory provisions regarding liability for defects apply. Notwithstanding this, the following applies to contracts for the delivery of goods:<\/p>\n\n<p><b>7.1<\/b>&nbsp;If the customer is acting as an entrepreneur,<\/p>\n\n<ul>\n<li>the seller has the choice of the method of subsequent performance;<\/li>\n<li>for new goods, the limitation period for rights regarding defects is one year from delivery of the goods;<\/li>\n<li>rights regarding defects are excluded for used goods;<\/li>\n<li>the limitation period does not restart if a replacement delivery is made under liability for defects.<\/li>\n<\/ul>\n\n<p><b>7.2<\/b>&nbsp;The limitations of liability and reductions of time limits set forth above do not apply<\/p>\n\n<ul>\n<li>for claims for damages and reimbursement of expenses by the customer,<\/li>\n<li>in the event that the seller has fraudulently concealed the defect,<\/li>\n<li>for goods which, according to their usual purpose, have been used for a building and have caused its defectiveness,<\/li>\n<li>for any obligation the seller may have to provide updates for digital products, in the case of contracts for the supply of goods with digital elements.<\/li>\n<\/ul>\n\n<p><b>7.3<\/b>&nbsp;Furthermore, for entrepreneurs, the statutory limitation periods applicable to any existing statutory right of recourse remain unaffected.<\/p>\n\n<p><b>7.4<\/b>&nbsp;If the customer acts as a merchant within the meaning of Section 1 of the German Commercial Code (HGB), they are subject to the commercial obligation to inspect and give notice of defects pursuant to Section 377 HGB. If the customer fails to comply with the notification obligations stipulated therein, the goods shall be deemed approved.<\/p>\n\n<p><b>7.5<\/b>&nbsp;If the customer is acting as a consumer, they are requested to report any delivered goods with obvious transport damage to the delivery agent and to notify the seller. Failure to do so has no effect on the customer's statutory or contractual claims regarding defects.<\/p>\n\n<h2>8) Liability<\/h2>\n\n<p>The seller is liable to the customer for compensation for damages and expenses arising from all contractual, quasi-contractual, and statutory claims\u2014including those based on tort\u2014as follows:<\/p>\n\n<p><b>8.1<\/b>&nbsp;The seller is liable without limitation on any legal ground.<\/p>\n\n<ul>\n<li>in cases of intent or gross negligence,<\/li>\n<li>in the event of intentional or negligent injury to life, body or health,<\/li>\n<li>based on a guarantee promise, unless otherwise stipulated,<\/li>\n<li>due to mandatory liability, such as under the Product Liability Act.<\/li>\n<\/ul>\n\n<p><b>8.2<\/b>&nbsp;If the customer acts as a consumer based in Germany or as an entrepreneur, the following limitations of liability apply:<\/p>\n\n<p>If the seller negligently breaches a material contractual obligation, their liability is limited to the foreseeable damage typical of the contract, unless they are subject to unlimited liability pursuant to the preceding section. Material contractual obligations are obligations imposed on the seller by the contract in order to achieve the contractual purpose, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer may regularly rely. Otherwise, the seller\u2019s liability is excluded, unless they are subject to unlimited liability pursuant to the preceding section.<\/p>\n\n<p><b>8.3<\/b>&nbsp;The foregoing liability provisions also apply to the seller's liability for its agents and legal representatives.<\/p>\n\n<h2>9) Redemption of promotional vouchers<\/h2>\n\n<p><b>9.1<\/b>&nbsp;Vouchers issued by the seller free of charge as part of promotional campaigns with a specific validity period, and which cannot be purchased by the customer (hereinafter referred to as \"promotional vouchers\"), may only be redeemed in the seller's online shop and only within the specified period.<\/p>\n\n<p><b>9.2<\/b>&nbsp;Individual products may be excluded from the voucher promotion if the terms of the promotional voucher specify such a restriction.<\/p>\n\n<p><b>9.3<\/b>&nbsp;Promotional vouchers can only be redeemed before the order process is completed. Retroactive application is not possible.<\/p>\n\n<p><b>9.4<\/b>&nbsp;Only one promotional voucher can be redeemed per order.<\/p>\n\n<p><b>9.5<\/b>&nbsp;If the promotional voucher applies to a specific monetary value rather than a percentage discount, the value of the goods must be at least equal to the amount of the promotional voucher. Any remaining balance will not be refunded by the seller.<\/p>\n\n<p><b>9.6<\/b>&nbsp;If the value of the promotional voucher is insufficient to cover the order, one of the other payment methods offered by the seller may be selected to settle the difference.<\/p>\n\n<p><b>9.7<\/b>&nbsp;The credit balance of a promotional voucher is neither paid out in cash nor does it bear interest.<\/p>\n\n<p><b>9.8<\/b>&nbsp;The promotional voucher will not be refunded if the customer returns goods paid for\u2014in whole or in part\u2014with the promotional voucher while exercising their statutory right of withdrawal.<\/p>\n\n<p><b>9.9<\/b>&nbsp;The promotional voucher is transferable. The seller may render performance with discharging effect to the respective holder who redeems the promotional voucher in the seller\u2019s online shop. This does not apply if the seller has knowledge, or is unaware due to gross negligence, of the respective holder\u2019s lack of entitlement, lack of legal capacity, or lack of authority to act.<\/p>\n\n<h2>10) Governing Law<\/h2>\n\n<p>The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding the laws governing the international sale of movable goods.
